Terms of Use

Welcome to RapGame (the "App"). The App is provided by Yauheni Babanin. By downloading, accessing or using the App, you agree to these Terms of Use (the "Terms") and our Privacy Policy. If you do not agree, please stop using the App.

1) Who may use the App

• You must be at least 13 years old, or the minimum age required by law in your country.
• If you are a minor, you may use the App only with any consent required from a parent or legal guardian.
• You must comply with these Terms and applicable law.

2) What the App provides

The App is a freestyle rap practice and entertainment product. It may provide beats, words or prompts, rhythm-based practice, recording tools, premium modes and other related features. Features and content may change over time.

3) Our license to you

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for its intended purposes. You may not copy, sell, redistribute, reverse engineer, interfere with, scrape or misuse the App except where applicable law expressly permits.

4) Your recordings and content

You retain ownership of original lyrics, freestyle performances and recordings you create. If the App allows you to upload or share content through our services, you grant us a non-exclusive, royalty-free license to host, process, reproduce and transmit that content only as reasonably necessary to provide the feature you chose to use.

You are responsible for content you create or share and for ensuring that it does not violate another person's rights or applicable law.

5) Beats and music

Beats, instrumentals and other audio supplied through the App are owned by us or licensed to us. Using a beat in the App does not transfer ownership of that beat to you. Any special restrictions that apply to exporting, publishing or commercially exploiting recordings that contain a particular beat may be shown in the App or associated license information.

6) Acceptable use

Do not use the App to break the law, infringe intellectual property or privacy rights, harass others, distribute malware, bypass paid features, manipulate purchases, attack our systems, use bots or scrapers, or otherwise interfere with the App or other users.

7) In-App Purchases & Subscriptions

• Billing is processed by Apple App Store or Google Play using your platform account.
• If a free trial is offered, it converts to a paid subscription unless you cancel before the trial ends according to the platform rules shown at purchase.
• Auto-renewing subscriptions renew until cancelled. Deleting the App does not cancel a subscription.
• You can manage or cancel subscriptions through your Apple or Google Play subscription settings.
• Refund requests for App Store or Google Play purchases are handled under the applicable platform rules. We generally cannot directly issue a refund for a transaction processed by Apple or Google.
• Prices and premium features may change. Any required notice or consent for price changes will be handled in accordance with applicable platform rules and law.

8) Analytics and attribution

The App uses analytics, subscription and attribution services such as Amplitude, RevenueCat, Firebase, Adjust and Meta SDK. Details about the data processed and your privacy choices are described in our Privacy Policy.

9) Intellectual property

The App, its software, design, branding, original content and other materials are owned by Yauheni Babanin or our licensors and are protected by applicable intellectual property laws. No rights are granted except those expressly stated in these Terms.

10) Feedback

If you voluntarily send feedback, ideas or suggestions, you allow us to use them to improve the App without compensation or restriction, provided we do not identify you publicly without permission.

11) Changes and termination

We may add, modify, suspend or remove features where reasonably necessary. You may stop using the App at any time. We may suspend access where necessary because of serious abuse, fraud, security risks, legal requirements or material violations of these Terms.

12) Disclaimers

The App is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee uninterrupted or error-free operation, that every beat or feature will remain available, or that use of the App will improve any particular musical or freestyle skill. Mandatory consumer rights remain unaffected.

13) Limitation of liability

To the maximum extent permitted by law, Yauheni Babanin will not be liable for indirect, incidental, special, consequential or punitive damages, lost profits, lost data or goodwill arising from use of the App. Where liability can legally be limited, our aggregate liability will not exceed the greater of EUR 100 or the amount you paid for the App during the previous 12 months. This does not limit liability that cannot legally be excluded.

14) Governing law and venue

These Terms are governed by the laws of Poland, without prejudice to mandatory consumer protections that apply in your country of residence. Courts in Warsaw, Poland have jurisdiction except where applicable consumer law gives you the right to bring a claim elsewhere.

15) Apple / Google platform terms

If you obtained the App through the Apple App Store or Google Play, your use and purchases are also subject to the applicable platform terms. These Terms are between you and us, not Apple or Google. Platform operators are not responsible for providing our support services except as required by their own terms.

16) Changes to these Terms

We may update these Terms as the App or applicable requirements change. The latest version will show the updated date and will be available through the App and/or our website.
